Area description

Kapiolani Park was named after the wife of King David Kalakaua. The Kapiolani Park Association was created in 1876 to manage the 108-acre park. The park was named "Queen Kapiolani Park" in 1877.

Queen Kapiolani Park is located within a short walk to the Honolulu Zoo, Waikiki Beach, Diamond Head Crater and the Waikiki Aquarium.

Kapiolani Park is home to Tennis Courts, Soccer fields, baseball fields, Archery Range, Exercise Equipment, Waikiki Shell and much more.

Diamond Head Crator is the provides a beautiful backdrop to Queen Kapiolani Park.

Sports

Kapiolani Park is where people enjoy sports such at tennis, archary, jogging, walking, soccer, and baseball. Several sporting events are held at Kapiolani Park such as the finish line for the Honolulu Marathon or the starting line for the Waikiki Rough Water Swim.

Exercise

Both residents and tourists, young and old, enjoy walking and jogging around Kapiolani Park. It is an enjoyable one mile around the park.

Picnic

Kapiolani park as a large selection of picnic tables for all to enjoy. They range from ocean front to diamond head views. Some picnic tables are under shade trees while others are in the sunshine.

CANCELLATION POLICY/INSURANCE POLICY/SECURITY DEPOSIT

-Any Owner or Guest (s) cancellation must be in writing and an e-mail with confirmation will meet our requirements.  If the cancellation is at the Owner’s request a full refund will be made to the Guests.

- For Guest(s)’ own protection, it is strongly recommended that Guest purchase travel insurance.  Travel insurance is available, and is the sole responsibility of the Guest(s) to secure.  There are several companies that provide travel insurance, and you are welcome to get a quote from www.travelguard.com or www.insuremytrip.com

-Should a Guest(s) cancellation occur, Guest(s) will be entitled to all monies paid less a $500.00 cancellation fee, as long as the property is re- booked for those dates.

-Should a  Guest (s) cancellation occur, and the property is not rebooked, and all monies due have been received, all monies are non-refundable except for the security deposit (if any is charged) and the cleaning fee.

-Should a Guest (s) cancellation occur and all amounts due have not been received, and the property is  not rebooked, all monies are non-refundable.

-No refunds will be made for late check-ins, early check-outs or no-shows.

-Refunds will be made only if the property rented becomes unfit for habitation and cannot be repaired or restored to its advertised condition at the time of occupancy.

ADDITIONAL INFORMATION

1.            No honking/drive slow- Please do not honk your horn at anytime or spin your tires when leaving the driveway or property.  Also as a courtesy, please drive slowly in/out and around the surrounding streets.

2.            Sand- Please make sure all guests wash the sand off their feet every time before entering the house.

3.            Please make sure hoses are turned off completely when you are finished using them and report any leaks.

4.            When going to the beach please use the beach towels provided. Do not use bath towels for the beach. When returning from the beach, please rinse bodies and feet using the outdoor shower or the outdoor hose. Please make sure to shake the sand out of the beach towels and beach mats before coming inside.

5.            Wet swimwear: Please do not lounge in wet swimwear inside the house

RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT

In consideration for the right to occupy the vacation rental, the each Guest acknowledges and agrees as follows:

1.            Guest(s) agree to inform any and all people who will be on the property at the request of Guest(s) or by invitation of the Guest(s), of the terms and conditions, and to monitor compliance with terms and conditions.

2.            Guest(s) agrees to hold Owner(s) and Agent(s) free and clear of any liability for damage to self or property, resulting from accident, injury, loss of enjoyment resulting from events beyond the Owner’s and Agent’s control (including, without limitation, inclement weather or Guest(s) non-compliance with the terms of the Booking Agreement).

3.            Guest(s) acknowledges that the release and hold harmless provision in paragraph 2 applies to all claims for injury or damage resulting from any cause, including the negligence of any party released herein. Guest(s) further acknowledges that this Agreement shall be binding on all family members, guests, including minors, guardians, heirs and any executor or personal representative or beneficiary.

4.            Guest(s) agrees that this Agreement shall be enforced to the full extent permitted by law. If any section or part of this Agreement is held not to be enforceable under the applicable law, the remainder of the Agreement shall be enforced. The release and indemnification provisions of this Agreement do not apply to reckless or intentional acts, unless such provisions are permitted by the applicable law.

5.            This Agreement is subject to the laws of the state of Hawaii. Any disputes are subject to be settled by binding arbitration in Honolulu, Hawaii according to the rules of the American Arbitration Association. The prevailing party in any arbitration or litigation shall be entitled to recover reasonable attorneys’ fees.

6.            I state that I am 18 years of age or older and legally competent to sign this Release of Liability and Indemnification Agreement. I understand that these terms are contractual and not a mere recital. I have signed this document of my own free act.

7.            Guest(s) hereby agree to indemnify, defend, protect and hold harmless Owner(s), Agent(s) and their respective present and former agents, representatives, affiliates, subsidiaries, parent companies, members, managers, directors, officers, employees, heirs, successors and assignees (collectively, the “Indemnified Entities”) and the property from and against all costs, fees, loss, liability, damage, expenses, demand, fines, penalty, claims, action or cause of action of any kind or nature (including attorneys’ fees and expenses) (collectively, “Damages”) to self or property arising out of accident, injury, use of the premises in contravention of the terms of this Booking Agreement loss of enjoyment resulting from the weather, inoperable appliances or equipment (including hot tub, barbeque, etc)
